Guide to Annual, Sick, and Parental Leave in Malaysia

Malaysia’s employment laws provide minimum leave entitlements to ensure employees can take necessary time off while maintaining job security. Leave entitlements under the Employment Act 1955 include annual, sick, maternity, and paternity leave, with some companies offering additional types of leave.


Annual Leave


Annual leave entitlements vary based on years of service:


   - Less than 2 years: 8 days per year

   - 2–5 years: 12 days per year

   - 5+ years: 16 days per year


Employees who haven't completed a full year of service may receive prorated leave based on their employment period. If not used within the entitlement period, annual leave may be forfeited unless the employment contract allows for carry-forward.


Sick Leave and Hospitalization Leave


Sick leave is also determined by the employee’s length of service:


   - Less than 2 years: 14 days per year

   - 2–5 years: 18 days per year

   - 5+ years: 22 days per year


All employees, regardless of tenure, are eligible for an additional 60 days of paid hospitalization leave if required. Medical certificates may be requested by employers for sick leave validation.


Maternity and Paternity Leave


   - Maternity Leave:

   Female employees are entitled to 60 consecutive days of paid maternity leave, regardless of service length or marital status.

   - Paternity Leave:

   Following amendments in 2022, eligible fathers now receive 7 days of paid paternity leave for each child, up to a maximum of

   five children per marriage.


Additional Leave Options


While not mandated, many employers offer extra leave types, such as:


   - Compassionate leave for family emergencies.

   - Marriage leave and pilgrimage leave for religious purposes.


These leave entitlements ensure employees can balance work and personal commitments.
